Clever Things and associated parties, referred to here as DSN team, runs and maintains the database service “Designer Showcase Network” (Network) for the virtual world of Second Life. The service connects designers and other kinds of content creators, referred to here as Content creators, and potential customers, referred here to as Subscribers, and allows a content creator to automatically send free samples to the subscribers of the network.

Joining the network as a Content creator, or subscribing to deliveries as a Subscriber implies agreement to these terms and conditions.

Content creators

1. Content creators pay a non-refundable, one-time entry charge to join the Network, and receive a dropbox, that will deliver the promotional sample to the subscribers of the network. Content creators are not required to give copies of their samples to DSN Team. The dropbox delivers the items on behalf and under the name of the content creator. Neither the Network itself nor the DSN Team deliver any promotional samples directly to subscribers and the Network exists solely to connect randomly chosen Subscribers with randomly chosen product samples.
2. While there is currently no running charge of any sort and the entry charge is the sole requirement for participation in the network, DSN Team reserves the right to institute such a running charge, monthly, weekly, or otherwise, if it will become necessary to support the continued operation of the Network. Because the Network design requires keeping the records of which transactions between the Subscribers and the Content creators have already occurred essentially forever, eventually the number of such records may exceed the available server capabilities and necessitate an upgrade. Should this hapen, members of the Network will be notified and this document will be suitably changed. Until it happens, DSN Team guarantees that any Content creator joining the Network under the current edition of these rules will receive at least a month of service for their entry fee with no extra charges, and Content creators having joined less than a month before the running charge is instituted will have their accounts suitably credited to ensure they have received at least a month of service for their entry fee. (Probably, about six months can be expected before this happens, but that depends on factors not in our control.)
3. Every Content creator certifies that they have full and exclusive rights on the promotional samples, that they consist primarily of their own creations and work, (where ‘own’ in case of collaborative work under the same brand may involve multiple avatars or people) and that 3rd party components (e.g. resize scripts or component scult maps) have been properly licensed as required by their respective authors. Items that are acquired primarily through purchase, affiliate sales, ‘Business-in-a-box’ kits and other third party means are not permitted as samples in the Network. Violation of this rule will result in suspending the Content creator’s user account until the problem is corrected, repeated violations will result in a permanent suspension.
4. Distribution of items that would be classified as ‘adult’ under the current Linden Labs adult content policies is permitted ONLY through a drop box set to handle the Adult channel. Content creators are required to strictly observe the ‘adult channel’ product category, and avoid sending out ‘adult’ samples in any other channel, even if they seem to fit the definition of that channel. Failure to do so will result in account suspension temporarily or permanently, at the discretion of the DSN Team. Distribution of information about ‘adult’ services is absolutely prohibited on all channels, including the Adult channel. If there are any questions about use of the Adult Channel, please contact the DSN Team.
5. Content creators are allowed to submit exactly one sample product per channel at any given time, for a total of no more than 9 products at the same time. They may change any of those products whenever they desire, but changing the sample product to a different one will in no circumstances result in a subscriber receiving a sample from a given Content creator in the same channel twice. Circumventing this limit to promote the same brand through the use of multiple avatar accounts is not permitted and will result in suspension of all accounts involved indefinitely.
6. Content creators are required to strictly observe ‘channel’ product categories, and avoid sending out samples in wrong channels. Failure to do so will result in account suspension until the problem is corrected. If in doubt, contact the DSN Team, and channel definitions will be suitably clarified for everyone.
7. Content creators agree to appropriately display at least one subscription kiosk on the territory of their main or sattellite places of business, and may use as many of those kiosks as they desire.

Subscribers

1. Subscribers can at any time subscribe to any of the 9 available channel categories, free of charge. That subscription is voluntary, which makes whatever objects sent to them as part of their subscription to the Network solicited. Should they desire to unsubscribe, they can do that themselves at any of the Network kiosks, or through a request sent in to DSN team by any means convenient, and that request will be honoured as soon as possible.
2. The Network connects Content creators with potential customers on a voluntary basis and in a randomized manner, as random as random number generation software allows. Subscribers are not entitled to receive daily items, specific items, or items from a specific designer. Content creators are not obliged to participate, or submit specific items, or to provide any kind of service for the items delivered. The promotional samples are intended to showcase the kind and quality of the Content creator’s work. Should the promotional sample please the Subscriber, they are strongly encouraged to visit the respective shop, but are under no obligation to do so.
3. Delivery of promotional samples occurs daily, with transactions being generated at 05:00 UTC, and will be filled during the following day, barring the associated delays imposed by Second Life, and every day, exactly one item per channel per subscriber will be delivered, based on whether a sample from a Content creator that the Subscriber has not received anything from yet in a given channel is available. That delivery comes from the randomly chosen Content creator directly, and the DSN Team cannot exercise any control over the content of the delivery before that delivery occurs and is reported as a violation of a rule, or undo whatever damage or offense that results. Therefore DSN Team disclaims any other responsibility arising from conflicts between Content creators and Subscribers.

Everyone

1. Content creators and Subscribers understand and agree that for the Network to function at all, their avatar names and unique ID numbers have to be stored in the database maintained by DSN Team, and will refrain from joining or subscribing at all if they do not desire that this would happen.
2. Once again: Content creators and Subscribers understand and agree, that just as giving away a sample of their product imposes no obligation on the Content creators, Subscribers receiving the said products are under no obligation resulting from receiving it. A free sample distributed through the Network is neither a privilege nor a right, but part of a marketing campaign.
3. DSN Team assumes no responsibility for reliability of the Network, or of the delivery, or of the other associated services, as these may be affected by superior forces, such as unreliability of the Second Life platform in general, network outages, outside influences and malicious intrusion. Despite that DSN Team pledges to make the best effort possible to ensure such reliability, our abilities to do so are not infinite.
4. DSN Team will not condone or tolerate Subscribers harassing Content creators in personal communication over the properties of the free samples received through the Network, nor will it condone or tolerate Content creators making demands on the Subscribers because of having sent them their free sample.
5. DSN Team has no other means of mitigating potential problems than suspending a user account, and for this reason, reserves the right to do so temporarily or indefinitely for any reason, listed here or not, with no explanations other than those demanded by basic human courtesy.
